1. Scope
This Privacy Policy describes how TierBench collects, uses, shares, and protects personal information when you visit our websites, create an account, or use the TierBench platform (the "Service"). It applies to account holders and visitors. It does not govern the rate, provider, and benchmark data sourced from publicly published files, which is business data, not personal information about you.
2. Information We Collect
Account information you provide. When you register or are provisioned an account, we collect your name, email address, company or organization name, and job title. We also record your acceptance of our Terms of Service and Privacy Policy, including the version accepted and the date and time of acceptance.
Information you submit through our forms. When you contact us, request a rate analysis, or enter your email to access a product demo on our website, we collect the information you provide — such as your email address and any name, organization, or message details you choose to include — so we can respond to you and follow up about TierBench.
Usage information. We collect information about how you interact with the Service — for example, queries you run, features you use, and timestamps — to operate, secure, and improve the Service.
Device and technical information. We collect standard technical data such as IP address, browser type, and similar information generated when you use the Service.
Authentication cookies. We use strictly necessary cookies to keep you signed in and to secure your session (see Section 4).
Payment information (when applicable). If and when paid subscriptions are activated, payments will be handled by a third-party payment processor. We do not collect or store full payment card numbers; the processor handles card data under its own terms, and we receive limited information such as confirmation of payment and billing contact details.
3. How We Use Information
We use personal information to: create and administer your account; authenticate you and secure the Service; provide, maintain, and improve the Service; record and manage your consent to our Terms and this Policy; communicate with you about your account, service updates, and support; monitor for and prevent fraud, abuse, and security incidents; and comply with legal obligations.
4. Cookies and Similar Technologies
The Service relies on strictly necessary cookies to function. After you sign in, we set secure, HTTP-only session cookies (such as the identity and access-session cookies) that your browser sends back with requests so you stay authenticated and your data requests are authorized. These cannot be read by client-side scripts and are scoped to the application. Because they are essential to providing the Service, the Service will not function without them.
We use a bot-protection challenge (provided by Cloudflare) on sign-up, sign-in, and the forms on our marketing website (such as our contact and demo-access forms) to defend against automated abuse. We do not use third-party advertising or cross-site tracking cookies.
5. How We Share Information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share personal information only as follows:
- Service providers (subprocessors). With vendors who process data on our behalf to run the Service, under contractual confidentiality and security obligations. Our current subprocessors are listed in Section 6.
- Legal and safety. When required by law, legal process, or to protect the rights, property, or safety of TierBench, our users, or others.
- Business transfers. In connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.
- With your direction. When you ask us to share information with a third party.
6. Subprocessors
We rely on the following providers to deliver the Service:

We will update this list as our service providers change. When paid subscriptions are activated, a payment processor will be added here.
7. Data Retention
We retain personal information for as long as your account is active and as needed to provide the Service, then for any additional period required to comply with legal obligations, resolve disputes, and enforce our agreements. Consent records (the Terms/Policy version accepted and timestamp) are retained as a record of agreement. You may request deletion as described in Section 9, subject to legal retention requirements.
8. Security
We use reasonable technical and organizational measures to protect personal information, including encryption of data in transit and at rest, HTTP-only secure session cookies, server-side authorization on data requests, and access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Your Rights and Choices
Depending on where you live, you may have rights regarding your personal information, including the right to access, correct, delete, or obtain a copy of it, and to ask us about how we handle it.
California residents (CCPA/CPRA). You have the right to know what personal information we collect and how we use and share it, to request access and deletion, to correct inaccurate information, and to not be discriminated against for exercising your rights. As noted, we do not sell or share personal information for cross-context behavioral advertising.

10. Healthcare Data
TierBench's Service processes provider, facility, and payer rate information derived from publicly published files, together with business-account information about our users. In providing the Service, TierBench does not collect, process, or store individual patients' protected health information (PHI), and does not act as a HIPAA covered entity or business associate in this capacity.
11. Geographic Scope
The Service is operated from and intended for users in the United States, and information is processed in the United States. If you access the Service from outside the United States, you do so on your own initiative. If TierBench begins offering the Service in jurisdictions with additional requirements, this Policy will be updated with the corresponding disclosures.
12. Children's Privacy
The Service is intended for business users and is not directed to children. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us and we will delete it.
13. Changes to This Policy
We may update this Policy from time to time. When we do, we will revise the version number and effective date, and for material changes will provide reasonable notice. The version of this Policy in effect when you use the Service governs.
